There are two Colts according to the Coroner and presented to the court by him One was Billy's and one was Franks and were found near them.
Keefe is the only person who claims there was a third gun and it was not a Colt but a distinctively different S&W. The two Colts are present and accounted for.
Thus the third "missing' gun is the S&W. Keefe identifies it as not missing but says he saw it a few minutes earlier in the Coroners office and then in the courtroom.
Then he identifies it on a table in the courtroom. Keefe is is then asked to examine it as to the maker and states it is a Colt. This makes the point Keefe does not know the difference and his claim of seeing a S&W and seeing the Colts that actually exist. Keefe's story about a missing S&W comes crashing down.
Fellehy, a witness at the Coroners hearing a few days earlier says about Tom, "He still held his pistol in his hand, but did not see it go off after he had fell." So the gun should still be in his hand or right near him if it was in his hand as he lay on the ground. Keefe said there was no gun in the area around Tom.
